Scope of Application
These General Terms and Conditions apply to all bookings, stays and services provided by Hofgut Wagrain – Apartment & Lifestyle Resort.

Unless otherwise stipulated in these General Terms and Conditions, the Austrian Hotel Contract Conditions 2006 (AGBH 2006), as amended from time to time, shall apply additionally.

Booking
A booking becomes binding upon receipt of the written booking confirmation. The prices, services, booking conditions and cancellation terms stated in the booking confirmation or offer shall apply.

Deposit and Payment
A deposit of 30% of the total booking amount is required at the time of booking. The remaining balance must be paid no later than upon arrival.

Booking Options and Cancellation Terms

Early Fix Booking
This rate is non-refundable. In the event of cancellation, 90% of the total booking amount will be charged. This rate can be booked up to 40 days prior to arrival.

Flex Booking
This rate can be cancelled free of charge up to 30 days prior to arrival. Any deposit already paid will be refunded. In the event of a later cancellation, 90% of the total booking amount will be charged.

Super Flex Booking
This rate can be cancelled free of charge up to 3 days prior to arrival. Any deposit already paid will be refunded. In the event of a later cancellation, 90% of the total booking amount will be charged.

In the event of a no-show or early departure, no refund will be granted for unused services.

We recommend taking out travel cancellation insurance.

Arrival and Departure
The apartment is available from 4:00 p.m. on the day of arrival. On the day of departure, we kindly ask guests to vacate the apartment by 10:00 a.m.

Early check-in or late check-out is available for an additional charge and subject to availability.

The resort facilities may already be used from 10:00 a.m. on the day of arrival and until 4:00 p.m. on the day of departure.

Use of the Resort and Facilities
All facilities, apartments, equipment and services of the resort must be used with due care and only for their intended purpose.

Parents and accompanying adults are responsible for supervising their children at all times.

The use of play, sports, wellness and leisure facilities is at the guest’s own responsibility and in accordance with any posted instructions. Guests must follow the directions of resort staff.

Changes to opening hours, programmes, services or weather-dependent activities remain reserved.

Notice Regarding the Fire Alarm System and Fire Brigade Call-Outs
The resort is equipped with a legally compliant and highly sensitive fire alarm system consisting of more than 700 detectors. This system serves to protect our guests, employees and the entire property.

We kindly ask guests to exercise particular care when using the kitchens. Excessive smoke or steam, boiling over liquids, intense frying or grilling may trigger an automatic alarm and result in the fire brigade being called out.

Should a fire brigade deployment be caused by improper, negligent or avoidable actions, we reserve the right to charge the responsible guest for the resulting costs. The volunteer fire brigade of Wagrain currently charges € 500.00 per deployment.

Please note that the members of the Wagrain fire brigade serve on a voluntary basis and interrupt their work, leisure time or family time when responding to an emergency call.

No Smoking Policy
The entire resort, including all apartments, is a non-smoking property. Smoking is only permitted in designated outdoor areas.

In the event of violations of the smoking policy or resulting special cleaning requirements, damages or fire brigade deployments, we reserve the right to charge the resulting costs to the responsible guest.

Damages and Special Cleaning Costs
Costs may be charged for damages caused, extraordinary soiling or lost items.

This applies in particular to damages to apartment furnishings, kitchen appliances, furniture, play and leisure facilities, wellness areas and all other resort facilities.

Pets
Pets are only permitted with the prior approval of the resort. Additional charges may apply.

Restaurant and Additional Services
The restaurant, breakfast service, take-away offers, shop and other additional services are available subject to opening hours, availability and operational conditions.

Parking and Charging Stations
Parking spaces are available subject to availability. To the extent permitted by law, no liability is assumed for parked vehicles or their contents.

Electric vehicle charging stations may be used subject to availability and at the applicable rates.

Events and Commercial Use
The apartments and facilities of the resort may only be used for accommodation purposes.

Events, celebrations, photo or film productions and any commercial use require the prior written consent of the resort.

Liability
The liability of the resort shall be governed by the applicable legal provisions and, additionally, by the AGBH 2006.

To the extent permitted by law, the resort accepts no liability for guests’ personal belongings, technical devices, vehicles, valuables or other items brought onto the property.

The use of technical infrastructure, digital services and other provided facilities is at the guest’s own responsibility, to the extent permitted by law.

Data Protection
Personal data is processed exclusively for handling enquiries, processing bookings and stays, and fulfilling legal obligations.

Force Majeure
If a stay cannot be carried out, or can only be carried out to a limited extent, due to force majeure, official orders, natural events, epidemics, pandemics, strikes, power outages or other unforeseeable circumstances, the applicable legal provisions and the AGBH 2006 shall apply.

Final Provisions
Austrian law shall apply.

To the extent permitted by law, the competent court at the registered office of Hofgut Touristik GmbH shall have jurisdiction.

The AGBH 2006 are available at www.hotelverband.at and will be provided upon request.

Should any provision of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
